Commission approves more private events at 1 Sansom conservatory; orders monthly reports after contractor error

Planning staff told commissioners that the site hosted 24 free events in 2024 and discounted nonprofit events; supporters said the Conservatory regularly attracts hundreds of visitors and helps downtown businesses.
Staff also reported an enforcement issue discovered after publication of the staff report: the Conservatory's operator had undercounted full closures in 2024 because of internal miscommunication and inconsistent record keeping. Planning staff said they confirmed 17 full closures in 2024 (five more than allowed) and 15 partial closures that year; as a result the property sponsor revised its reporting procedures and committed to better record keeping.
Project sponsor Phil (project sponsor/tenant at the site) told the commission the operator takes responsibility for the reporting errors and described operational constraints that had led to the miscount. He said the operator wants the Conservatory to remain an active public space and that increasing the permitted number of full closures will let the operator schedule private events more predictably and use income to sustain the Holbrook House restaurant and free programming.
Speakers from nearby businesses and industry groups — including the Hotel Council of San Francisco, Per Diem Restaurant Group, and downtown business advocates — testified in support, saying the Conservatory drives foot traffic and helps downtown recovery. Opponents and some neighborhood commenters urged caution about privatizing POPOS and asked for time limits or sunset language.
After discussion, commissioners voted to approve the increase but added a condition: instead of the previously required six-month affidavits, the operator must submit monthly affidavits to the planning department's zoning administrator documenting closures and records of events. Commissioners said the monthly reporting requirement will reduce confusion and create a clear audit trail. The commission's final motion approved the mandatory discretionary review with the monthly reporting condition; the vote was unanimous.
