Commission approves Lexmark site AVI building but flags tree‑canopy and stormwater items

The commission unanimously approved PLN MJDP 25‑13, an amended final development plan for an automated vehicle inspection (AVI) structure at 1180 Newtown Pike, a site associated with Lexmark/Progressive Company operations. The structure is roughly 50 by 31 feet and approximately 19.5 feet tall and will include vehicle queuing and restriping.

Staff noted several sign‑offs required by the technical committee including a tree inventory and tree protection plan (Article 26), a lighting plan (Article 30) and documentation that the stormwater quality requirements in the stormwater manual are met. Staff found a discrepancy between canopy acreage on older plans (3 acres) and the requirement (4.5 acres) that had been corrected in the current submission but needed graphical verification on the tree protection map.

Todd Mazurek representing Progressive Company said the misstatement was a typo and that the project team will submit a corrected tree preservation/planting plan and that they are working with engineering on stormwater infrastructure.

Planning commissioners asked for a timetable and clarification; the applicant said the site has been in development for roughly two to three years and that the outstanding items will be documented and completed before certification. Commissioner Mickler moved to approve PLN MJDP 25‑13 with removal of the U.S. Postal Service kiosk sign‑off (staff recommendation); Jonathan Davis seconded. The motion carried unanimously.

Staff will require the urban forester's approval of the tree preservation plan and engineering sign‑offs for stormwater quality and any stormwater infrastructure shown on the plan before issuing final certification.
