Committee approves procurement cleanup bill, mandates training for agency procurement staff

The Senate State Agencies & Governmental Affairs Committee voted to pass Senate Bill 538, a technical cleanup and clarification of procurement statutes that includes a new training requirement for department procurement staff.

Senator Gilmore, sponsor of the bill, told the committee the measure corrects technical drafting errors and “asks the department to promulgate rules” related to procurement. He said the bill grew out of prior questions raised about procurement contracts and the need to ensure consistent practice across agencies. "One of the things that this does is it mandates the procurement office to do training within department procurement offices to make sure they understand process," Gilmore said.

Committee discussion included concerns about consultants and contract performance. Senator King questioned whether procurement reforms should include clawbacks or other accountability measures for outside consultants who failed to deliver promised savings; Gilmore and other senators said the bill is focused on statutory clarity and training rather than creating new clawback mechanisms. Senator Dodson, who has studied procurement in prior years, described procurement law as complex and said the training requirement would help departments avoid common mistakes.

The committee voted the bill out without public testimony recorded. The committee chair announced the bill passed.

Senate Bill 538 directs the Office of State Procurement to promulgate rules, report training efforts to the Arkansas Legislative Council, and support agency-level procurement offices to reduce errors and improve compliance.
