Council approves first reading to rezone 2200 Mistletoe Avenue from R2 to O3

The Waco City Council on April 15 approved on first reading an ordinance to change zoning for approximately 0.2577 acres at 2200 Mistletoe Avenue from R2 to O3.
Director Peters told council the Plan Commission recommended approval by a 10-0 vote, finding the proposed O3 designation consistent with the comprehensive plan and appropriate because existing O3 zoning and commercial uses are adjacent to the subject property. Peters said public infrastructure would be adequate "once the street is upgraded at the developer's expense at the time of development," and that the property meets area and width requirements for O3 zoning.
There were no public speakers at the hearing and council moved and seconded approval on first reading. The roll call recorded affirmative votes and the motion passed.
The ordinance amends Section 28-247 and other portions of Chapter 28 of the City of Waco Code of Ordinances and includes standard penalty, saving and severability clauses. Council did not specify a timeline for the developer to upgrade the street; Peters said the street upgrade would be required at the time of development and at the developer's expense.
Because the action was approved on first reading, further consideration will follow the city's normal ordinance adoption schedule.
