Public works director: city received IDEQ notice of noncompliance on stormwater permit; options under review

Jason Van Gilder, Middleton’s public works director, informed the council that the city received a notice of noncompliance from the Idaho Department of Environmental Quality (IDEQ) concerning its stormwater discharge permit.
Van Gilder said the general permit covers the city’s storm drainage and is due for renewal; it expires on Sept. 30 and IDEQ requested renewal paperwork on April 2. He described Middleton as “an anomaly in cities our size” because most similar cities are not subject to the same permit requirements.
Staff held an informational meeting with IDEQ on the matter and said they are “still evaluating our options” and would return to the council with more information. Van Gilder recommended that council members direct any immediate questions to him, City Attorney Mark Hilty or City Engineer Amy Woodruff.
No formal action was taken; Van Gilder characterized the notice as “not unexpected” and said staff will provide additional analysis at a future council meeting.
