The Board of Supervisors on May 22 approved interim zoning controls to impose an 18‑month requirement for conditional use permits and specified findings before a retail use in the C3R Downtown Retail Zoning District may be converted to a non‑retail sales and service use.
Supervisor Peskin described the controls as a temporary tool while the city completes a permanent policy in collaboration with the Planning Department and the Office of Economic and Workforce Development (OEWD) to ensure “value recapture” for conversions in the Union Square area. Peskin moved — and the board approved without objection — an amendment that exempts any site south of Market Street within the C3R zoning district and any site that had already obtained conditional use authorization from the Planning Commission for such conversions on or prior to May 18, 2018.
The board adopted the interim controls as amended unanimously. Sponsors said they did not expect the controls to last the full 18 months, but rather to expire once permanent regulations are adopted through the normal planning process.
