The Defiance City Council adopted three pieces of legislation in a single meeting: an ordinance accepting perpetual easements for the Whispering Pines subdivision, an ordinance designating eligible depositories for city funds through Sept. 30, 2030, and a resolution adopting the Defiance Parks and Riverfront Master Plan with a provision for annual review.
Whispering Pines easements
Councilmember presentation: The ordinance concerns a new housing development off West Rosewood Avenue that will be recorded as Whispering Pines. City staff said the council previously vacated right-of-way and now staff recommends accepting two perpetual easements: one for stormwater management in dispersed locations inside the development and a second to maintain access to an existing public sanitary sewer main that runs through the parcel.
Staff clarified the scope of the stormwater easement: it gives the city the right to enter private property to address blockages or maintenance but does not create an obligation for the city to perform repairs or maintenance. The presenter cited Ohio appellate case law in explaining the liability limits (transcript reference to Essman v. City of Portsmouth).
Outcome and vote: The ordinance was adopted. Roll-call affirmations were recorded during the meeting; multiple council members answered “yes” during the vote call. (Transcript records a roll-call affirmation for the motion to adopt.)
Depositories ordinance
Councilmember presentation: City finance staff presented a routine five-year ordinance listing eligible institutions to hold city deposits from Oct. 1, 2025, through Sept. 30, 2030. The institutions named in the ordinance were listed during the meeting as State Bank and Trust, Farmers and Merchants State Bank and Lehi Banko.
Outcome and vote: The ordinance was adopted on first reading by caption with a recorded affirmative vote in council.
Parks and Riverfront Master Plan resolution
Councilmember presentation: City staff and members of the public had contributed to a parks and riverfront master plan. The resolution formally adopts the plan and includes a requirement for an annual review to align implementation with available funds and community priorities. A council member explicitly noted that adopting the plan does not obligate the city to expend the plan’s full estimated cost — a figure referenced in the meeting as more than $144 million — and that the annual review is intended to stage and prioritize work based on funding availability.
Rusty (council member), speaking during the discussion, said: “Passing this motion doesn't obligate the city to … spend the over $144,000,000 price tag for all the plan recommendations.” Another council member said adopting the plan supports future grant applications by showing the council’s commitment. The resolution was adopted by recorded affirmative vote.
What the actions mean
- The easements for Whispering Pines give the city entry rights to maintain stormwater flow and sewer access but do not shift primary maintenance liability from property owners and the homeowners’ association. - The depository ordinance lists which financial institutions may hold the city's funds for a five-year period beginning Oct. 1, 2025. - The parks plan is adopted as council policy guidance; implementation remains subject to budget constraints and grant success, with an annual review required to inform priorities.
Recorded actions, as entered in the meeting record, are summarized below.
