Commission approves sidewalk-waiver for Rosita Valley replat in ETJ

The Eagle Pass Planning and Zoning Commission on Thursday approved a sidewalk-waiver request for a proposed replat of a 5-acre parcel in Eagle Development Subdivision Unit 1, Track 27, located off Rosita Valley Road in the city’s five-mile extraterritorial jurisdiction (ETJ).
Planning Department staff explained the applicant, represented by engineer Hector Canales, P.E., requested a waiver to not install a required sidewalk along the road perimeter for a replat that would create two additional lots. Staff said the parcel is vacant, the platting will be reviewed administratively and the area lacks curb and gutter. The department reported five mailed notices, one returned as undeliverable, and no letters in favor or opposition. Staff recommended granting the waiver under City of Eagle Pass Code section 23-64.
Staff also said the county inspector emailed concurrence, noting that when curb-and-gutter is absent the sidewalk requirement is typically deferred until infrastructure improvements occur. "Whenever there's curb, then we require that the sidewalk be installed before the plat gets recorded. But in this case, there's no improvements or no infrastructure," Planning Department staff said.
The commission closed the hearing after no audience speakers signed up, voted on a motion to grant the waiver, and the motion passed. Staff said the final plat and any address/911 validation will be handled administratively during subdivision review.
