Everett council records judge—s ruling on District 4 eligibility; approves consent items, schedules final readings

The Everett City Council on Sept. 10 received a legal update from the city attorney that a Superior Court judge ruled a District 4 candidate ineligible to appear on the ballot, and the council approved five consent items by roll call.
City Attorney David Hall briefed the council that after hearings in both the county auditor—s office and Superior Court, Judge Oakwood ruled that “Mr. Battle is not eligible to appear on the ballot,” and ballots were being printed without his name, the attorney said.
The council approved the minutes of the Sept. 3 meeting and passed five consent items during the Sept. 10 meeting. The roll calls recorded affirmative votes from Council member Bader, Council member Ryan, Council member Voguely, Council member Tuohy and Vice President Zarlingo. President Schwab was recorded as excused for the meeting.
Clerk announcements and staff reports noted two items read into the record for final readings scheduled one week later: an ordinance establishing a special improvement project titled Riverpointe Outfalls Replacement, and an ordinance amending the city—s 2025 budget and amending ordinance number 4099-25. Council staff read a separate proposed council bill (listed as Council Bill 2,500,848) for first reading: an ordinance to create a special improvement project titled North Broadway Pedestrian Bridal (Fund 303, Program 133); that item was presented for first reading with no council action taken.
Mayor Franklin provided a number of administrative updates earlier in the meeting, including reminders about open board and commission vacancies and construction and paving schedules for Broadway; Mayor Franklin said three nights of paving remained in the schedule, weather permitting.
No executive session was held and no formal votes on the first-reading council bill occurred at the Sept. 10 meeting.
