Council discusses stalled sewer work tied to wetlands permitting and Bear River Water coordination

Willard City Council heard updates about several infrastructure matters affecting proposed subdivisions and canyon access, including a delayed sewer line due to wetlands permitting questions and coordination needs with Bear River Water for water metering and billing.

Council members and staff said construction of a sewer extension for a large proposed development is delayed while jurisdictions and legal counsel consider whether wetlands in the route fall under federal jurisdiction; the council referenced the Sackett court case as a reason the U.S. Army Corps of Engineers and other agencies have not issued a clear ruling. Staff said the uncertainty has stalled obtaining a required 404 permit or equivalent authorization for work across wet areas.

Council also discussed how the city plans to bill for water: staff recommended Willard City read meters and bill customers directly, then remit amounts due to the Bear River Water Conservancy District, because local billing provides the city a mechanism to enforce nonpayment by withholding other municipal services if necessary. Council asked staff to follow up with Bear River Water and report back.

Separately, councilors described near-term work on canyon trail access agreements, noting most draft agreements are complete but that the county must finalize its acceptance of a dedicated trail or right-of-way before the city can finalize easements and perform construction work. Council asked staff and the city engineer to finalize property descriptions and meets-and-bounds to clear remaining title and easement issues.
