Wellington council approves two code amendments, attorney contract extension and routine items; residents press for traffic-signal fix

The Village of Wellington council on April 8 approved multiple routine and legislative items in unanimous votes and received public comment about an intermittent, safety-critical traffic signal.

The council voted 5-0 to approve: the meeting agenda; the consent agenda; Ordinance 2025-09 to add a definition of "normal hours of operation" to the code of ordinances; and Ordinance 2025-10 to amend noise standards and permitted lawn-equipment hours. The council also ratified an extended employment agreement with the village attorney.

Ordinance 2025-09: Council members codified a definition of "normal hours of operation" for consistency across the code. The definition adopted reads 7 a.m. to 10 p.m. Sunday through Thursday and 7 a.m. to 11 p.m. on Friday and Saturday. Staff said the change aligns the code with the land development regulation provisions that refer to "normal hours." The ordinance passed on a unanimous vote after a public hearing; no speakers opposed the measure.

Ordinance 2025-10: The council amended chapter 13 (offenses and miscellaneous provisions), article 2 (noise standards). The ordinance expands the examples of machinery and construction work covered by the prohibitions and adjusts allowable hours for some activities: it moved the Saturday start time for certain construction and machinery operations back to 8 a.m. from 7 a.m., proposed prohibitions for machinery and construction between 8 p.m. and 7 a.m. Monday through Friday (Sunday prohibitions remain in place), and narrowed permitted lawn-equipment hours Monday through Saturday to 8 a.m. to 8 p.m. (Sunday lawn equipment use remains allowed 9 a.m. to 6 p.m.). The ordinance passed 5-0 after a public hearing.

Village attorney contract: The council ratified a multiyear extension of the village attorney's employment agreement, extending the contract through April 1, 2029, by unanimous vote. The attorney stated she was satisfied with the negotiated terms.

Consent agenda and routine business: The agenda and consent agenda passed 5-0. The council also appointed a voting delegate and alternate for the Palm Beach County League of Cities; council members volunteered for those roles during the meeting.

Public comment — traffic signal petition: Several residents from the Hidden Creek/Glen Willow neighborhood urged the council to press Palm Beach County to make a malfunctioning traffic signal at Binks Forest Drive and Bent Creek Road operate full time, rather than functioning only during school hours. Residents said the signal often reverts to flashing on non-school days, creating confusion and safety concerns. The council replied that the village will first repair the signal (staff noted a planned $143,000 software/upgrade work referenced during the discussion) and then revisit the petition for a permanent operational change. Residents said they had circulated a petition with roughly 99 signatures asking for a full-time solid signal.

Public comment on noise enforcement: During the public hearing on the noise ordinance, resident Bruce Toomin asked how the village would enforce the ordinance's 100-foot audible standard and recommended including decibel measurements and holiday hours explicitly in the code to avoid ambiguous enforcement.
