Committee advances bill expanding conscience protections, including for medical research and whistleblowers

Senator Kim Hammer presented Senate Bill 444 and the committee advanced the measure after a brief floor presentation and no public opposition during the hearing.
Hammer said the bill would add "medical research" to the list of health-care services covered by the state’s Medical Ethics and Diversity Act of 2021. He described the change as covering medical research that is often not part of a patient's specific clinical care, citing examples such as "research on aborted fetuses or gain of function viruses," and said the bill also adds broader conscience protections for workers who object to participation in gender transition procedures and related services. "This is an effort to get ahead of an issue," he said, adding that the bill provides job-safety protections for health-care providers who are whistleblowers and allows providers to seek protections from government authorities if an employer does not recognize an objection.
The bill also contains language preventing state boards and agencies from punishing or retaliating against a health-care provider for protected speech unless that speech resulted in patient harm, and it prohibits state boards or agencies from forcing a person to be a member of a particular private licensing body.
No committee members registered public opposition during the hearing; the committee adopted the bill by voice vote. Hammer closed by asking the committee for a favorable report.
