The Benbrook City Council on Thursday voted unanimously to adopt an ordinance vacating and abandoning a 10-foot public utility easement on Lot 1, Block 1, Legend Manor Addition, at 8 Legend Road in Benbrook, Tarrant County.
Assistant City Manager Mr. Cox told the council that the easement in the rear yard contains no existing utilities and that franchise utility partners and the city's stormwater utility indicated there is no future need for utilities in that rear yard. “The item before you this evening is an ordinance to vacate and abandon a 10 foot public utility easement on a property located at 8 Legend Road in Benbrook, Texas,” Mr. Cox said. He added that the front-yard easement is currently used, but the rear easement is not.
The council opened a public hearing as part of the agenda item; no members of the public spoke and the hearing was closed. The property owner attended but did not address the council during the hearing. After the hearing, a council member made a motion to vacate the rear utility easement; the motion was seconded by Dr. Marshall, council member, and carried on a roll call vote.
During the staff presentation Mr. Cox said staff had contacted franchise utilities, “BWA, telecom, as well as our own stormwater utility,” and that those partners confirmed there was no existing infrastructure and no anticipated need in the rear yard. Council members did not request further study or conditions before voting.
