Commission approves one-year extension to record final plat for B-3 zone change at 2812 N. Rock Road

The Derby Planning Commission voted 7-0 Thursday to grant a one-year extension for the applicant to record a final plat required under a previously approved zone change at 2812 North Rock Road, moving the deadline to Aug. 27, 2026.
Background: City staff said the council approved a zone change for the property from R-1 to B-3 on Aug. 27, 2024. The approval required the final plat to be recorded within one year; the applicant’s intended user is no longer pursuing the site and the applicant requested additional time to secure a new user and proceed with platting.
Commissioner Heffler moved to approve the extension to Aug. 27, 2026; the motion was seconded and carried 7-0 (Adams, Ehman, Heflin, Hessletime, Quigley, Renberger, Voth).
Other business: the commission chair directed the committee responsible for the zoning and subdivision regulation review to meet again to develop recommended language on window signs and to work with staff and affected vendors prior to bringing a recommendation back to the full commission. The chair said the committee should move more quickly than the typical November schedule and consider screening and security uses for signs, noting public comment on the topic posted to the Derby Informer.
The extension preserves the zone-change approval while giving the applicant additional time to secure a user and complete final platting.
