Board continues code-enforcement appeal after property owner says she did not receive hearing notice

The Board of Adjustment continued indefinitely a code-enforcement review of case V202302237 after the property owner, Deborah K. Carter of Buckhorn Trail, said she received no certified notice of earlier proceedings and asked staff to coordinate on-site inspections to explain permitting requirements.
Chip, a county code‑compliance inspector, told the board staff inspected the Whitman-area parcel in November 2023 and found occupied RVs, portable restrooms and trash. A hearing officer later found respondents responsible and imposed an initial noncompliance fine and a prospective daily fine beginning October 14, 2025 if the property remained out of compliance. Carter told the board she had not received notice of the initial hearing and that no one had lived in the trailers for over a year, saying she used one trailer for storage after moving due to financial reasons: “I never received a notice or anything about the property… there has not been anybody living in those trailers or that trailer for over a year,” Carter said.
Staff offered to coordinate a new hearing and an on-site inspection to explain permitting and entitlement limitations. Darren, county staff, told the board a parcel inside the Luke Air Force Base overflight/clear zone cannot be permitted for residential occupancy or mobile homes under a memorandum of understanding and applicable state rules. After staff proposed scheduling and coordinating an on-site inspection, Chairman Loper moved to continue V202302237 indefinitely; Member Clapp seconded. The motion passed by roll call.
ACTIONS AT MEETING: V202302237 (code enforcement review) continued indefinitely by unanimous roll-call vote. Staff committed to coordinate an on-site inspection and assist the respondent with understanding applicable permitting limits.
