Committee approves revised soil‑stockpile agreement with Majestic Midwest Innovation Center

The Kenosha Public Works Committee on April 14 revisited and approved revisions to a soil‑stockpile performance agreement between the City of Kenosha and Majestic Midwest Innovation Center LLC.

Staff presented a series of textual edits intended to clarify the agreement's description of the stockpile. Among the revisions read into the record were adding a clause that the soil stockpile was created by the development of the former Dairyland Greyhound dog track prior to the developer owning the real estate, and replacing plural references to "stockpiles" with the singular "stockpile" throughout the document. Staff also proposed deleting several phrases that described prior site improvements and replacing other clauses to read that the stockpile "remains" on the real estate and is to be removed by the developer in accordance with the development agreement.

"The revisions that we're looking to apply to this agreement... each time it says stockpiles, it should be stockpile," staff member Kader read during the meeting. Committee members agreed to bring the item back up, the revisions were read aloud for the record and the committee voted to approve the agreement as revised.

Committee members said the applicant has communicated with the committee and that there was a pending confirmation from the Department of Natural Resources related to the site. The motion to approve the agreement with the stated edits passed by voice vote.

The city will finalize the agreement text and proceed with the performance agreement as revised.
