Supervisor Stephanie moved to "affirm the determination made by the Planning Department that the proposed project at 3637 and 3657 Sacramento Street is categorically exempt from further environmental review and deny the motion in item 9." Supervisor Safaie seconded the motion; the board approved it on the same-house, same-call procedure.
The project had multiple linked agenda entries. Items 8 through 10 addressed the environmental (CEQA) exemption: item 8 to affirm the exemption, item 9 to reverse the exemption determination, and item 10 to direct preparation of findings if reversal occurred. Items 11 through 13 concerned the conditional‑use authorization.
After the board's action on the exemption, supervisors re-referred items 11, 12 and 13 "until further notice" to allow additional discussion with the city attorney. When the items were brought back later in the meeting, Supervisor Stephanie moved to continue items 11 through 13 for one week to Feb. 12; that motion was seconded by Supervisor Peskin and passed on roll call (10 ayes; Supervisor Haney absent).
The board's action left the Planning Department's categorical-exemption finding intact while deferring final decisions on the conditional-use authorization and on preparation of any findings in support of disapproval. The continuance gives parties additional time to meet and to allow the board to receive further briefing from the city attorney and the parties.
Planning staff and the deputy city attorney were present during discussion; no new environmental analysis was ordered at that time. The board's written records for the Sacramento Street matter will reflect: affirmation of the categorical exemption (item 8), tablement/re‑referral of the conditional‑use items (11'013), and a formal continuance of the re-referred items to Feb. 12.
The board did not adopt substantive findings reversing CEQA coverage on the record; instead, the matter remains open for the conditional‑use issues tied to the same project.
Looking ahead, the board will revisit items 11'013 at its Feb. 12 meeting, per the motion passed on the record, unless parties request further continuances or the board receives additional materials that resolve outstanding questions.
