SAN FRANCISCO — The Board of Supervisors passed on first reading an amendment to the Planning Code on June 5 that increases the Transportation Sustainability Fee (TSF) by $5 to $24.04 for qualifying nonresidential projects, with a different adjusted rate in Central SOMA, and added an exemption for projects covered by certain previously approved development agreements.
Supervisor Peskin introduced the ordinance and asked for an oral amendment to clarify that development agreements the board already approved — specifically those covering Mission Bay and Pier 70 — would not be subject to the new fee. Deputy City Attorney John Givner told the board that an uncodified section could be added to the ordinance recording that exemption and that the board could authorize the change verbally at the meeting.
Supervisor Tang said she ultimately would support the measure on the floor but repeated concerns raised in committee about adjusting the fee before the Controller's office completes its five-year impact-fees analysis; Tang estimated the increase would raise about $11 million in additional revenue. On the advice of legal counsel the exemption's effective cut-off date was set to June 5, 2018 for clarity; the board approved the amendment and the ordinance as amended passed its first reading unanimously.
