Supervisor David Chiu Avalos introduced a substitute ordinance on May 19 to clarify that the city's inclusionary affordable-housing requirements apply to group housing projects.
Avalos said the inclusionary program was intended from its creation in 2002 to cover group housing but that at some point the Planning Department had taken an informal position excluding certain group housing from inclusionary obligations, creating a technical loophole. He said developers have proposed market-rate group housing projects that could avoid providing inclusionary units under the departmentinterpretation, and that some Planning Commission members have expressed concern that group housing is being used to evade city requirements.
Avalos's substitute ordinance would apply to any project that has not received a first construction permit by May 19 and would close the technical loophole so projects cannot proceed without inclusionary housing contributions. He urged the Planning Commission to delay hearing permits for new group housing projects until the ordinance is considered.
