Centerville planning commission approves final site plan for Porter Lane Estates with conditions

The Centerville Planning Commission on an administrative motion approved the final site plan for Porter Lane Estates, a proposed residential subdivision at 522 West 400 South (Parcel 030010209), contingent on outstanding DRC comments and final administrative review.
Planning staff told commissioners the applicants, Greg M. Larson and Troy Holzer, applied for final site-plan approval under the plan development overlay (PDO), have paid required fees and have addressed most conditions set by the planning commission at the conceptual review. "We have deemed them compliant, and they have paid their fees," a planning staff member said during the meeting. Staff recommended approval so long as outstanding DRC comments are resolved.
The project’s only substantive change from the previously approved conceptual plan is the creation of a separate Parcel A for a sport court that had previously been shown as part of Lots 3 and 4. Planning staff said parcelizing the sport court prevents future disputes over ownership or use by adjacent lots. "Parcel A is the sports court, and we originally did not have that parcelized out … to alleviate that for the future residents," planning staff said.
Commissioners asked who would own and maintain Parcel A; staff said the subdivision’s CC&Rs (covenants, conditions and restrictions) were updated to make the lot part of the homeowners association's maintenance obligations. "It was added as a parcel that is part of their maintenance obligation," planning staff said. Commissioners and staff clarified that the city does not routinely enforce HOA maintenance but could explore legal avenues if residents request action.
Other items raised during discussion included: a list of outstanding DRC comments (including incorrect lot frontages on the plan set caused by the new Parcel A), a previously requested fire inspection that staff said has been addressed in the revised materials, and city requirements for street lighting (reviewed by the public works director and road supervisor). Staff said lot-frontage corrections and other engineering items were being resolved and the team planned to seek subdivision compliance review with the DRC on October 6.
Developers Greg M. Larson and Troy Holzer answered commissioner questions and confirmed that stormwater and other technical issues had been addressed since the prior meeting.
A planning commissioner moved to approve the final site plan for the property located at 522 West Porter Lane (400 South), contingent on three conditions and five findings listed in the staff report. The motion received a second from Commissioner Jorgensen and passed unanimously.
Staff noted that administrative processing remains: the final subdivision plat will continue through internal DRC review and the zoning administrator will sign the mylar and manage bonding once code requirements are met.
The commission’s approval allows the applicants to proceed with final subdivision compliance processing, but does not complete recordation or bonding steps required for final plat recordation and construction to begin.
