Staff says local agritourism opinion exempts one operator from special‑use permit; county to refine agritourism rules

Madison County planning staff told the commission on Sept. 17 that activities at a property operated by a Mr. Lipscomb on Hoover Road fall under the State of Virginia27s agritourism definition as reflected in a Commonwealth's Attorney opinion, and therefore do not require a special‑use permit under current legal interpretation.

Alan said the county has identified that the operator27s activities meet the state definition of agritourism and noted staff is reviewing options “for addressing this and narrowing the scope of what agritourism means as well as figuring out what a substantial impact is to the general public.” He said staff will present updated options soon. The commission discussed potential regulatory responses to limit misuse, including defining "devoted to bona fide production," setting acreage or yield thresholds, and addressing traffic, events and lodging impacts.

Staff noted short‑term rentals are explicitly excluded under the current attorney‑opinion interpretation, and that some elements of an agritourism operation (for example, RV parks or organized camping) would still be regulated through their applicable codes. The commission and staff agreed agritourism can be a positive supplemental income source for farms but also said they want to avoid the county becoming “a blank slate” where small production claims are used to justify larger commercial event venues without appropriate checks. Staff said more precise county definitions and impact thresholds will be drafted for the commission to review.
