Eagan council continues hearing on vacation of drainage, utility easements at 550 Opperman Drive

The Eagan City Council on April 1 closed the public hearing and voted to continue consideration of a petition to vacate drainage and utility easements on Lot 1, Block 1, YMCA Second Edition (550 Opperman Drive).

City staff told the council the petition, received Feb. 14, came from a representative of the property owner seeking the vacation to allow a replat and a revised easement layout. "Staff did receive a petition from a representative of the property owner of 550 Opperman Drive requesting the vacation of the existing drainage and utility easements," Miss Miller said during the hearing.

The request drew no public objections in advance of the meeting. Russ Mathis, Eagan's director of public works, told the council that the existing easements were originally acquired at no cost to the city and that the easements would be rededicated as part of the replat, again at no cost to the city. Mathis also said the developer would realign a sanitary sewer line to accommodate the development and the city. "There will be a slight change in one of the easements because the developer is going to realign sanitary sewer, to accommodate both the city and the development," Mathis said.

Councilman Fields moved "to close the public hearing and continue the vacation of the public drainage utility easement on Lot 1, Block 1, YMCA, Second Edition" (the motion referenced several recorded easement document numbers in the staff packet). The motion was seconded and carried on a voice vote with no recorded objections. Council discussion noted the matter would return with the replat; staff said the item is expected back within the next two meetings and will be finalized at the time of final plat.

No members of the public addressed the council during the hearing, and staff indicated two conditions in the staff report would apply if the council ultimately approves the vacation and replat.

The council took no final action to vacate the easements at the meeting; the matter was continued to a future meeting pending submittal and review of the final plat.
