Planning commission recommends approval of WF Real Estate rezone for 40-acre parcel

The Elbert County Planning Commission on April 15 recommended that the Board of County Commissioners approve WF Real Estate’s request to rezone a roughly 40-acre parcel (Parcel No. 6425100023) from Agriculture to Residential Agriculture (case RZ2024-0023).
The change would allow the property owner, applicant John Wilson, to use the site under the county’s Residential Agriculture (RA) zoning standards rather than the Agriculture (AR) district. For planning staff, Kelsey Landen of the Elbert County Planning Department presented the application and noted the primary difference between AR and RA is a lot-width standard (200 feet for RA versus 250 feet for AR); both districts allow a 10-acre minimum lot size. “For the record, my name is Kelsey Landen, and I'm with the Elbert County Planning Department. And tonight, I will be presenting w f real estate rezone. That is case number RZDash2024Dash0023,” Landen said during the staff presentation.
Staff found the proposal met the six rezone criteria in Article 3.C.4 of the Albert County Zoning Regulations, including consistency with the comprehensive plan, compatibility with surrounding uses, and no adverse impacts to public services or traffic. Planning staff also reported that Public Works had inspected and approved the access road. The staff recommendation carries three conditions: removal of public hearing signs within 14 days of final action; payment of all fees and satisfaction of conditions before the rezone becomes effective; and recordation of all required documents within 180 days of Board of County Commissioners approval.
The applicant, John Wilson, spoke briefly and identified himself as the controlling member of WF Real Estate. “My name is John Wilson. I'm the controlling member of WF Real Estate. I live at 9366 Oak Brush Way in Lone Tree, and thanks for your consideration,” he said.
Commissioners asked a few clarifying questions about road status and packet materials. Commissioner Nicole Hunt complimented staff on the packet’s organization and the follow-up with referral agencies. After discussion, a commissioner moved to recommend approval to the Board of County Commissioners subject to the conditions in the staff report; the commission voiced support and the motion passed. The commission did not record a roll-call vote on the motion in the hearing transcript.
The item is scheduled to be heard by the Board of County Commissioners on April 23. The planning commission’s recommendation is advisory; final approval and any recordation steps are the responsibility of the Board of County Commissioners and the applicant.
