Hurricane City Council approved a boundary-line agreement that corrects title errors affecting land around the city's West Well.
Staff told the council that a title search and survey revealed overlapping property descriptions from earlier transfers. Western Mortgage and adjacent private owners proposed an agreement to set the common boundary to match the ground stakes and to correct the chain of title. Staff said the proposed adjustment will reduce the city's recorded acreage at the site by approximately 5,015 square feet but will not affect the well, its appurtenances or the city’s ability to operate the facility.
Ken, the city’s water superintendent, said staff met with the property owners and that gates and access plans are in place so public-utility operations will not be impeded. Arthur, a city staff member who presented the item, said the documents were prepared at the private owners' expense and reviewed by the city engineer and city attorney.
Council members moved and seconded approval of the boundary-line agreement; roll-call votes were recorded and the council adopted the agreement. Staff said the city is not surrendering operational control of the well and described the action as correcting a historical deed error rather than a discretionary disposal of city property.
