Supervisor Scott Wiener, the district supervisor for the project, told the board the agreement resolves outstanding CEQA and conditional‑use issues by affirming a categorical exemption from environmental review and by approving a modified conditional‑use authorization with changes to conditions 8 and 9 and the addition of a new condition (condition 10) as specified in the settlement document. The settlement agreement was distributed to board members and signed by counsel for Children's Day School and the appellants.
The board took public comment, heard no additional speakers, and voted on the motions. The board approved the exemption affirmation and the amended conditional‑use authorization; a roll‑call vote on the exemption determination produced 10 ayes. The motion on the conditional‑use authorization passed similarly without objection.
Supervisor Wiener said the agreement was the product of direct negotiations among neighbors and the school and will avoid protracted litigation between the parties. The board directed the clerk to prepare the findings required by the motions.
