Representative Suzanne Vail and others asked the committee to consider HB380, which would remove a second felony penalty that currently applies to qualifying therapeutic cannabis patients or caregivers who unlawfully sell their supply. Supporters said the extra, program‑specific felony is out of proportion to other cannabis‑sale penalties and can carry severe collateral consequences for patients.
Jerry Kanirk, chair of the Therapeutic Cannabis Oversight Board, told the committee the program participants already face civil consequences — including loss of certification — and would still be subject to the same criminal penalties as any other person who unlawfully sold cannabis. "Therapeutic cannabis patients should not be treated any differently than any other individual who unlawfully sells cannabis in the state," he said; the board voted in favor of the change.
Representative Heath Howard and physician witnesses described the proposed change as a fairness measure that would not prevent prosecution for diversion but would remove an additional statutory punishment that can carry a severe financial and custodial sentence. Opponents, led by Sue Hamola of Smart Approaches to Marijuana, said current penalties had not caused documented problems and urged caution, arguing the bill is unnecessary.
