The San Bernardino City Council on April 16 reported it approved a $1,000,000 settlement in closed session in litigation filed by a minor, Mark Detine, according to the acting city clerk.
The settlement was disclosed at the start of the council’s evening open session. Acting City Clerk reported that "there was a motion made by council member Knauss, seconded by council member Ybarra, to settle that case for an amount of $1,000,000. That motion passed by a vote of 4 to 3." The clerk read the roll of votes in favor and opposed during the public report.
The settlement resolves Mark Detine’s lawsuit against the city in San Bernardino County Superior Court, case number CIV DS 2016739. Under the report to the council the votes in favor were Councilmembers Sanchez, Ybarra, Charette and Kanas; votes against were Mayor Pro Tem Figueroa and Councilmembers Flores and Ortiz. The acting city clerk did not provide additional terms of the agreement during the public report.
The disclosure followed the council’s closed session earlier in the afternoon and evening. No additional documents or the text of any settlement agreement were published on the council agenda packet that evening; the acting city clerk limited the public report to the motion, dollar amount and the roll call tally.
The council did not take further public action on the matter during the remainder of the meeting. The reported motion and vote were the only formal details released to the public during the meeting.
The case remains a matter of public record at the San Bernardino County Superior Court under the cited case number.
