Beaumont council acknowledges CFAC finding on park improvement bidding

The Beaumont City Council on April 15 formally acknowledged receipt of a February 14 letter from the California Uniform Construction Cost Accounting Commission (CFAC) finding the city in violation of Public Contract Code section 22042 related to the City of Beaumont Park Improvement Project (24-05).
City Manager Elizabeth Gibbs told the council that CFAC’s review followed a complaint filed by the construction industry force account council. Gibbs said staff and legal counsel attended CFAC hearings on January 10 and January 31 and presented evidence the city believed contrary to the commission’s position. The commission nevertheless voted 5–4 to find a violation, she said.
The commission’s regional compliance manager, Patricia Rescon, addressed the council during the public hearing and thanked the city for acknowledging the finding and for agreeing to participate in an upcoming CFAC training session. "CFAC is a resource for questions related to public works bidding and contracting," Rescon said, and invited staff to contact her with any follow-up questions.
The nut of the council action was procedural: state law requires that the commission’s finding be presented to the legislative body within 30 days of receipt and that a public hearing be held within 60 days. Council moved to acknowledge receipt of the commission’s February 14 letter and to accept staff’s plan to attend CFAC training; the motion passed on a roll call vote with all members voting yes.
City staff framed the item as an opportunity to strengthen contracting practices and invited council to direct any follow-up actions after the CFAC training. There were no public objections recorded at the hearing.
The acknowledgment does not itself change any municipal code or contract; it is an administrative step required by the public contract code and a prelude to the training and internal review staff said it will carry out.
Council members voting yes on the roll call were Council member Phinn (Finn), Council member Martinez, Council member White, Mayor Pro Tem Voigt and Mayor Lara.
