McKinney council amends city manager contract after executive session; details not disclosed

The McKinney City Council moved into executive session and later voted to amend the city manager’s employment contract, a council member said at the meeting.

Before the executive session, the presiding officer cited Texas Government Code sections 551.071 (consultation with attorney), 551.072 (deliberations about real property), 551.074 (personnel matters) and 551.087 (economic development). The council listed specific matters for closed deliberation: pending or contemplated litigation in SLC McKinney Partners LP v. City of McKinney, cause number 493019832024; deliberations about downtown city-owned property redevelopment; the city manager’s annual performance evaluation; and economic development matters described as Project Hemispheres and Project Lasso. The presiding officer stated the council would move into executive session at 4:06 p.m.

After the closed session, a council member moved “that we amend the employment contract for our city manager as discussed in executive session,” and another council member seconded the motion. The presiding officer called for a voice vote and said, “Aye.” No roll-call votes or the text of the amendment were read into the public record; the council did not specify the amendment’s terms during open session.

The council’s invocation of the cited Government Code sections is consistent with statutory allowances for confidential attorney–client consultation, personnel deliberations, real-property negotiations and economic-development negotiations. Because the substance of executive-session deliberations is confidential, the council did not disclose details of the discussion or the contract amendment in open session.
