Ellis County Commissioners Court approved a series of plats, variances and family‑exemption requests during its regular meeting, clearing multiple residential lots in several precincts while attaching staff‑recommended conditions.
The approvals cover two variance requests to minimum public road frontage standards (Jacinto addition and Butler Lane additions), a family plat exemption under the Texas Local Government Code, and final or preliminary plats for smaller subdivisions including Clarity Venture LLC, Lusk Estates, Main Estates (Phase 1), Old Boyce Farms, Rhonda Estates, Avalon Acres, Ellis Estates, JMK property, and Peaks at Lone Elm.
The court first heard the Department of Development presentation from Alberto Matas, development director, explaining that the standard public road frontage requirement is 150 feet and describing the parcels that fell short or were along unpaved/frontage roads. “Staff does recommend approval of this variance request subject to the 4 conditions that are found in the staff report,” Matas told the court for the Jacinto variance request. For multiple plats, staff either recommended approval subject to technical conditions or reported the applicant had met the conditions and staff recommended approval as presented.
Key approvals and conditions - Item 1.1 (Jacinto addition variance & related plat): Approved a variance from the 150‑foot public road frontage requirement (parcel with 109 feet frontage). Motion to approve staff recommendation with conditions was made by Commissioner Grayson and seconded by Commissioner Stinson; vote carried. Conditions included submitting a plat identical to the survey plat, no further subdivision until requirements are met, exclusion of multi‑tenant/commercial uses, and address verification. - Item 1.2 (Butler Lane variance & later final plat at 1.11): Approved variance for non‑paved frontage and later approved the final plat (1.11) subject to a right‑of‑way condition. Motion by Commissioner Ponder to approve item 1.2 was seconded by Commissioner Butler; both variance and final plat later carried. - Item 1.3 (Planning/family exemption under Texas Local Government Code §232.0015(e)): Approved a family exemption for a 1.004‑acre gift from grandfather to grandson subject to five conditions including that a future sale outside the family requires platting the entire property; motion by Commissioner Stinson, seconded by Commissioner Grayson; motion carried. - Multiple final and preliminary plats (items 1.4–1.14, including Clarity Venture LLC, Lusk Estates, Main Estates Phase 1, Old Boyce Farms, Rhonda Estates, Avalon Acres, Ellis Estates, JMK property and Peaks at Lone Elm): Ratified staff approvals or approved plats subject to technical conditions (right‑of‑way labeling/dedication, ETJ/withdrawal notations, utility/hydrant labeling, drainage/study requirements, and correcting legal descriptions). Motions were introduced by various commissioners and carried by voice vote.
Notable: Peaks at Lone Elm (item 1.14) is a larger final plat proposal for roughly 205.73 acres creating 146 residential lots plus two HOA‑maintained lots; staff recommended approval subject to 13 technical conditions including final plat labeling, adjustments to three lots found non‑compliant, right‑of‑way dedication and traffic‑sign placement per the Texas Transportation Code. Commissioners discussed road‑naming and ensuring traffic signage is placed before permits issue.
Why it matters The court’s approvals permit a number of residential developments to move forward across multiple precincts in Ellis County and set the conditions that applicants must satisfy before final subdivision approvals or any future commercial conversion. Several approvals referenced withdrawals from neighboring cities’ extraterritorial jurisdictions and noted required dedications to meet the county thoroughfare plan.
What’s next Applicants must submit plats that match the survey instruments and meet the listed conditions (right‑of‑way dedications, drainage/civil plans, utility and hydrant locations, updating legal descriptions) before final development moves ahead. Several items remain contingent on applicants meeting the staff‑listed technical conditions.
