The Germantown Board of Mayor and Aldermen on April 14 voted to advance repeal of municipal code section 11-33, the city's seasonal special-event decorations ordinance, to a third and final reading after the city attorney said the code raises legal concerns.
City Attorney Goodman told the board he had reviewed the seasonal declaration ordinance since the first hearing and recommended repeal so staff could draft a replacement on firmer legal footing. "I do have some legal concerns about that, and for that reason I would recommend that it be repealed," Goodman said during the second-reading public hearing.
The mayor opened a public hearing; no members of the public spoke. Alderman Sherry Hicks moved to approve the repeal for further review; Alderman Yulicki seconded. The clerk called the roll and the motion passed by voice roll call. The board scheduled the third and final reading for the next meeting on April 28, 2025.
No replacement ordinance was adopted at the April 14 meeting; the repeal motion advances the item to a subsequent meeting so staff may prepare proposed alternatives.
