City Attorney Mr. Dahl informed the Wheat Ridge City Council April 14 that a protest against the Lutheran Legacy Campus rezoning met the city’s home rule charter threshold and that, under city code, the second-reading public hearing must be continued to the council’s next regular meeting.
Dahl said the charter gives adjacent property owners the right to protest zoning changes and that if a valid protest is signed by 20% of the property owners adjacent to any side of the rezoned property, the council must approve the ordinance by a three‑quarters majority. He said staff had reviewed the submitted protest, determined it met the 20% standard, notified the protesters, and that the hearing would be continued to April 28 with new notice measures (new signs and mailed notices) to increase public awareness.
Because the protest arrived after first reading and before second reading, Dahl said the code automatically continues the hearing; no council motion was necessary. The council acknowledged the continuation and moved to the next agenda item.
The rezoning proposal would change the Lutheran Legacy Campus from a mix of planned hospital/commercial/residential zones to a mixed-use MU-LLC zone district; the council opened the hearing but did not take testimony at this session because of the protest and the required continuation.
