District notes federal DOE pause on DEI certification request; considers resolution seeking full IDEA funding

During the legislative committee update, district staff summarized a rapidly evolving federal development: the U.S. Department of Education had requested that states certify compliance with a February Dear Colleague-style directive concerning curriculum and civil-rights enforcement. The district reported that the request went to states rather than to individual school districts and that, as of the afternoon before the meeting, an injunction (and an Education Department stay) paused enforcement and the certification requirement through April 24.
Mrs. Oakwist (legislative update presenter) said Michigan's state superintendent sent a response to the U.S. Department of Education indicating Michigan believes it already complies with Title VI of the Civil Rights Act of 1964 and therefore the state would not distribute the certification request to local districts. The presenter said that, as of the meeting, 16 states indicated they intend to sign the certification, 11 have declined and others were undecided or had not disclosed positions publicly.
Separately, the committee discussed proposed advocacy on special-education funding. Staff presented a draft resolution, coordinated through the K-12 advocacy group K-12 Alliance, urging Congress to restore full funding under the Individuals with Disabilities Education Act (IDEA). The resolution recalls that IDEA originally contemplated a federal contribution of 40% of the average per-pupil cost for special education; staff noted federal funding remains near 10.7% and districts continue to fund the remainder locally. Committee members supported reviewing and bringing the resolution to the regular meeting for possible board approval and advocacy in Washington.
No formal board action occurred at the study session. Staff recommended monitoring the federal litigation and, separately, bringing the IDEA-funding resolution to the next regular meeting for board consideration.
