City staff told the council this acquisition is necessary for multiple Spring Creek basin projects west of I-35 and south of Second Street. The staff presentation noted sanitary-sewer improvements were identified in the city's 2013 Water Resources Master Plan and that the specific parcel (Parcel 8 LLC/Spector Holdings) has been the lone holdout: the city said it first offered to purchase the parcel in March 2022 but was unable to reach agreement.
Staff said the sanitary sewer project has grown from roughly $10 million to $15 million as costs and scope evolved. The council discussed the need to move forward to add system capacity and improve resilience to erosion. Following a motion, the council voted to approve Resolution 17-25 and authorized acquisition by eminent domain if necessary.
The staff presentation included maps showing proposed sanitary sewer alignments and trail improvements; the acquisition is tied to both utility capacity improvements and trail connectivity in the Spring Creek basin.
