TREC receives legislative update on bills affecting licensure and board composition

Tennessee Real Estate Commission staff provided a legislative update on several bills affecting regulatory boards and licensure, describing the bills’ current status and likely next steps.
Why it matters: Pending state legislation can change statutory requirements for board composition, renewal timelines and other licensing processes that the commission administers. Commissioners said they would follow amendments as the General Assembly acts and expect rulemaking to follow enactment of any statutes.
Staff summarized five measures they had tracked. One bill (SB0886) would remove language that encouraged appointing authorities to appoint individuals of racial minorities to regulatory boards; staff reported it passed the legislature on April 7, 2025, and was enrolled for the governor’s signature. Another measure described as the “Less Is More” act would modify requirements for in-person grand-division meetings, limit late-penalty assessments for license renewals and change expiration/renewal timelines; staff said the bill’s provisions were still moving and had seen amendments. A third measure (SB0226/HB0470), described as a professionals’ freedom-of-religion bill with provisions on adverse board action and membership in real-estate organizations and MLS access, was taken off notice and was not moving forward as of staff’s update.
Staff said additional rulemaking packages might follow any enacted legislation and promised further updates at the commission’s June meeting.
Commissioners thanked staff and asked that the commission be kept informed as bills advance and as rule changes become necessary.
