Planning commission recommended denial of tobacco license application near park after officials say applicant already sold tobacco without a license

City council members discussed a tobacco retail-license application (agenda item 23) after staff briefed them that the site fails the ordinance's proximity rule and that the Planning Commission recommended denial.
The most immediate issue is location. "Due the proximity to parks at that location...that location is not...qualify under the proximity distancing requirements under the tobacco ordinance to get one," Deputy Commissioner Jake Dishaw told the council when asked to explain the law applied to the application.
Councilors also raised enforcement concerns. Staff said the applicant has been selling tobacco without a license, and that was repeated at the Planning Commission hearing. Dishaw said the applicant repeatedly acknowledged selling tobacco at the Planning Commission meeting. Councilors noted that an applicant who is already selling without a license faces a separate enforcement issue in addition to licensing and zoning concerns.
Dishaw told the council there are site deficiencies that would need correction before the applicant could successfully reapply. Among items he listed was a site-parking issue: some areas that should be grass are currently paved. He said, if the applicant addressed those site features and the proximity issue, the applicant could potentially reapply and have the application reconsidered.
The Planning Commission has recommended denial; the council did not record a final vote on the matter during the discussion captured in the transcript.
Councilors asked staff to stay available during later agenda items and to remain on hand while the council moved through related business.
