Authority approves 21-acre Riverside donation despite density waiver; one member opposed

The Albemarle County Conservation Easement Authority approved acceptance of a 21.7-acre donation along Riverside Road in the northeast part of Charlottesville, staff said, despite staff noting the proposal does not meet the authority's standard density guideline.

Staff described the property as 21.7 acres with archaeological and agricultural resources and noted the site sits amid an area with many existing easements. Proposed deed terms would prohibit subdivision and willful demolition of the existing main dwelling; the main dwelling (about 2,300 square feet) could be expanded or replaced up to 4,000 square feet if circumstances required. The owner intends to permit a second dwelling/ADU up to 1,000 square feet to be contained within a barn that has not yet been built. Staff said it would also allow conversion of an existing small shed near the dwelling into a guest cottage of up to 650 square feet that would not count as a dwelling so long as the unit lacks separate cooking facilities.

Staff requested feedback because the parcel did not meet the authority's usual density elements. Members noted proximity to other conserved land and the restrictive dwelling terms as reasons they were comfortable proceeding. A member moved to approve the easement as presented; another seconded. The motion passed on a voice vote; the transcript records one member—identified as Giannos—as opposed. Minutes were requested to reflect the guideline discussion for future reference. Staff will finalize deed language and record the easement.
