Town records administrative subdivision and lot merges after 2022 court judgment

Planning staff told the North Smithfield Planning Board that the town has recorded an administrative subdivision and the related lot merges required by a Superior Court judgment issued in February 2022.
The filing addressed a street-abandonment matter that had been part of a court settlement with the town. Staff said the judgment required the town to abandon a paper street and, as a condition, to merge adjacent lots so the area would not create an extra buildable parcel. The planning office reopened a file when an attorney for the buyer noticed that the original street-abandonment and administrative subdivision had not been recorded.
"This is a street abandonment as a result of a superior court judgment against the town... because of a transaction of this property and a title search the attorney representing the buyers noticed that the street abandonment and the administrative subdivision never occurred so he came back to the department," planning staff said. Staff reported that the subdivision and merges were recorded and the matter is now closed administratively.
No additional action by the planning board was required beyond the recording; the board moved to adjourn shortly after the administrative-subdivision update.
