Committee recommends reverting Title IX harassment policy after federal rule vacatur

The Policy Committee voted to recommend reverting the district's student/employee sexual harassment policy (policy 113) to its prior language after a federal judge vacated the 2024 Title IX rule.
Committee chair Brian Nichols summarized the legal prompt for the change: "A federal judge, on January 9, vacated the 2024 Title IX rule nationwide," he said, and that vacatur returned enforcement to the prior regulatory framework. Members said the district had previously revised its policy at administrative expense to conform to the now-vacated rule and that revising again to the prior text avoids additional legal costs.
The committee moved to "recommend to the full board of education the approval of the revisions of policy 113 student employee sexual harassment policy, Title IX waiving first reading and approval for final reading." The motion was seconded and approved by voice vote.
The recommendation restores the district's policy language to the pre-2024-rule framework; the committee cited the court decision as the reason for reversing the earlier change. The full board will consider the recommended revision at its next meeting.
