Bay County’s special magistrate accepted code enforcement’s recommendation Thursday to proceed with abatement at 9407 Indian Bluff Road unless the property is purchased and repaired. The magistrate added a provision delaying demolition until May 1 and said demolition would stop if a prospective buyer closed the purchase before that date.
Background and county recommendation The property was found in violation by a prior magistrate order (Feb. 13, 2025) that gave the respondent time to comply; staff reported subsequent noncompliance and advised abatement. Inspector Thorpe and Tony Burney described repeated inspections and ongoing junk, trash, and an unfit structure. No engineering or permit applications had been submitted as of the most recent inspection.
Prospective buyer and neighborhood comments Austin Savage, who said he had been working to purchase and rehabilitate the property, told the magistrate he had paid a deposit and had contractors on standby. Neighbor Steve Zantz supported code enforcement’s recommended disposition but said he was concerned the purchase process could be delayed by clerical deed issues and that demolition might proceed before any closing.
Asbestos testing and demolition timing Code enforcement said it would schedule an asbestos survey (typically returned within 5–7 days after sampling) and that demolition cannot proceed safely until survey results are available. The magistrate ordered that demolition not begin before May 1 and said if the prospective buyer closes before the county begins demolition, the county will pause abatement. Code enforcement indicated the county would bid the demolition or abatement work and that demolition would likely start in mid-May if the property remained unsold and no permits were filed.
Ending The magistrate’s order balances the county’s need to abate a repeatedly violative property with a short accommodation for a potential purchaser; staff will proceed with asbestos testing and bids and will proceed with abatement after the May 1 timeline if no purchase and permitting activity are documented.
