Lakeway approves variance allowing Del Mario restaurant to place playground, dumpster and propane tank inside rear setback

The Lakeway Commission on April 10 approved a variance allowing structures at Del Mario Mexican Restaurant, 1113 Ranch Road 620 North, to be placed inside the city’s 40‑foot rear building setback.
Agent Eduardo Aguirre, of Malone Wheeler civil engineering, told the commission the request would allow the restaurant’s owners, Mario and Leslie Sidro, to relocate an existing dumpster and propane tank and add a kitchen preparation area and a small playground/yard‑games area to support a planned parking lot and business expansion. "This is a critical path item for our client, to be able to expand and to be able to meet other, needs of the city so that their their business continues to grow and and and provide services to this community," Aguirre said.
The application seeks permission to place playground equipment, a screened dumpster, an above‑ground propane tank and associated screening up to 28 feet into the 40‑foot setback. Aguirre said the bank required the owners to show the business could expand and generate additional revenue in order to approve financing needed to regrade and pave a new parking area that would meet Lakeway code.
Commission members asked whether the neighboring storage facility had been contacted and whether screening and safety measures would be included in the final plans. Aguirre said mailed public notice had been provided and that the development department would review a full plan set for code compliance. "These are all schematics," he added. "We haven't put together a plan set that we will present to the city development department for review." Staff also said playground safety and building code matters would be reviewed by building division staff and would be subject to applicable international safety codes during plan review.
No members of the public spoke on the item during the meeting. A motion to approve the variance as requested carried by voice vote; the chair announced, "It's approved. Thank you." The applicant and staff said they would proceed to prepare the detailed site and building plans for the city’s development review.
The permit decision allows the owners to move forward with the design and building permit process; specific construction details, screening heights and playground fencing will be set during the formal plan and building‑permit review process.
