The Leavenworth County Planning Commission voted 8–0 to approve a lot depth‑to‑lot width exception for a proposed lot split at 19575 Mitchell Road, an application identified in the agenda as Smith’s Corner (DEV25‑013).
Planning staff said the applicants propose to split an existing roughly 5‑acre parcel into two parcels of roughly 2 and 2.5 acres. The exception pertains to Lot 1 Alpha, which would exceed the 1:1 depth‑to‑width ratio established in Article 50, Section 40.3(I). Staff told the commission that the existing access is restricted on Tonganoxie Drive and the two new lots will access Mitchell Road; an access easement over Lot 1 Alpha will serve Lot 1 Bravo. Staff recommended approval, noting the request meets the three criteria for an exception.
Commissioners asked whether the proposed driveway separation would meet a 400‑foot separation standard and were told public works had previously approved the existing entrance. Planning staff said the existing entrance location is already approved and built and the current lot split would place an access easement over that entrance. "They have an approved entrance. They have an entrance built out. It's there. They're just placing the easement over at this time," planning staff said.
A commissioner moved to approve the exception from Article 50, Section 40.3(I) and find that the three criteria for an exception had been met; another commissioner seconded the motion. The motion carried on a roll call vote of eight yes to zero no. Planning staff recorded that this item does not proceed to the Board of County Commissioners.
