Council approves use permit for short-term rental at 125 North Fourth Street with limits on occupancy and parking

Hampton City Council approved Use Permit 25-0079 to allow a short-term rental (STR) at 125 North Fourth Street in the Buckroe 1 short-term rental overlay, with 15 conditions designed to protect neighborhood integrity and public safety.
Planner Hanh Du presented the application. The house is an approximately 3,800-square-foot single-family structure with eight bedrooms and seven bathrooms. Because the number of rentable bedrooms exceeded thresholds for an administrative permit in the Buckroe 1 zone, the application proceeded as a use permit. Staff confirmed the property met density and separation requirements for the overlay and said the application includes adequate on-site parking beyond the four spaces required for eight bedrooms.
Staff recommended conditions that limit overnight lodging to no more than 10 people, limit to no more than eight bedrooms to be rented at any time, require minimum on-site parking to be available at all times, prohibit events, set a daytime occupancy cap (20 people between 7 a.m. and 10 p.m.), require a locally responsible contact person and a ledger of guests to be kept and produced on request. Planning Commission and staff recommended approval with 15 conditions; no public speakers were recorded at the hearing.
Attorney John McCormack and applicant Jason Valentine addressed the council. Valentine said he had updated marketing listings after the Planning Commission review to ensure current and future reservations comply with the 10-guest limitation and that a July reservation exceeding that number had been canceled. Councilman Randy Bowman moved approval; the council voted unanimously in favor (Bowman, Vice Mayor Steve Brown, Councilwoman Carolyn Campbell, Councilwoman Ferebee, Councilwoman Hope Harper, Councilwoman Martha Mugler, Mayor Jimmy Gray).
The permit approval allows the property owner to operate the STR provided the homeowner and manager comply with all 15 conditions; staff will enforce the permit requirements and may revoke the permit for noncompliance.
