Benton County community development staff told the planning commission Jan. 2 they expect Republic Services to file a conditional‑use application for a Coffin Butte Landfill expansion in early 2024 and described steps the county will take to ensure transparency and sufficient technical review.
Darren Nichols said the landfill operator has signaled its intent to file a permit application and that, when it does, the county will host a publicly observable pre‑application conference where the applicant presents materials and county staff and any participating state agencies may ask questions. Nichols said the pre‑application conference will not be a town hall or public‑comment forum but will be observable so interested members of the public can watch the presentation and staff Q&A.
Nichols also said the county has retained outside land‑use counsel and a planning‑consulting firm to help review any future landfill application. "We've identified outside land use firm and outside third party council to help the planning commission and the board of commissioners work through that application review, staff report, and, public hearings process," Nichols said.
The commission discussed conflict‑of‑interest and ex‑parte concerns. Andrew Struthers urged caution about commissioners attending pre‑application conferences, saying attendance could raise ex‑parte issues; staff said observing the pre‑application conference as a non‑participant would normally not disqualify a commissioner from later deliberation but that the county would confirm with county counsel and outside counsel. Nichols said commissioners should notify staff if they feel observation compromises their ability to be impartial.
Staff also warned that the landfill review will be complex and contain deadlines tied to formal land‑use review. Nichols encouraged commissioners to raise issues early and told the group the county will provide additional support and briefings to prepare the commission when an application arrives.
No application had been filed as of the Jan. 2 meeting; staff said Republic Services has repeatedly signaled its intention to file and that timing remained the operator’s decision.
