Planning commission sets tentative April hearing dates for Republic Services expansion; details on record, rebuttal and deliberation timeline

Benton County staff and the Planning Commission agreed on a tentative hearing schedule and procedural approach for the Republic Services landfill expansion application, aiming to complete public-record building in April and to deliberate on May 6.

Department staff said Republic Services submitted supplemental materials in mid-January and that staff considers the application technically complete but expects some supplemental work; the applicant requested additional time to strengthen the submittal. Staff told the commission it plans to post agency referral materials and open an extended public comment period once the remaining documents arrive and to provide a six-week overall public-comment window where possible.

Commission consensus was to tentatively schedule three public hearings to "build the record" and take oral testimony on April 15 (Tuesday), April 17 (Thursday) and April 22 (Tuesday). The commission discussed and agreed on a structure for the hearings: an initial evening primarily for staff reports, the applicant and governmental agencies; subsequent evenings for public oral testimony; a written-comment period to remain open following those hearings (staff discussed using a 7-day written-comment window), a 7-day rebuttal period for the applicant, and a target deliberation/decision meeting on Tuesday, May 6.

Petra, the department head, told the commission staff would synthesize incoming comments into thematic exhibit lists and would post agency comments verbatim as exhibits so commissioners and the public can review the original submissions. Petra also said that, while staff believes this application is more complete than the prior one, commissioners should expect the public comment dynamic to remain vigorous and that staff will work to make the applicable code sections and key exhibits accessible on the county website.

Commissioners discussed logistics and public-participation rules. They asked staff to provide: clear displays or handouts that explain the legal criteria commissioners must use (law, plan, code), a visible countdown clock for 3-minute public comment slots, a sign-in system for in-person speakers and a way for remote participants to register. Commissioners agreed a 3-minute limit for oral public testimony is appropriate and that technical, lengthy materials are better submitted in writing.

The commission also discussed ex parte contact procedures and potential conflicts or appearance-of-bias questions. Staff will add language to the opening script asking whether anyone in the room wishes to challenge the objectivity of a commissioner; that procedural language is intended to give members of the public an opportunity to record such concerns at the outset of a hearing.
