Alex Miller, code enforcement officer for the City of St. Cloud, presented photographs, mailings, and inspection notes documenting that windows were installed without any permit application and that an earlier permit application for an air-conditioning installation had been revoked by the contractor in July 2024. Miller told the magistrate the AC unit had been installed and that re-inspections in 2025 showed no permits on record.
Miller summarized the city's recommendation: the respondent be found in violation for performing work prior to obtaining permits and be given until Oct. 10, 2025 to obtain required permits or be assessed a daily fine of $250 until compliance is met. Miller also requested recovery of $318.48 in administrative costs incurred by the city for processing and the hearing.
The magistrate reviewed the evidence and said he would "find in favor of the city, find the respondent is in violation for work without permits, both for the air conditioning unit replacement as well as the installation of new windows without proper permits. Allow the respondent until 10/10/2025 to obtain the permits." The magistrate ordered that the administrative costs of $318.48 be paid within seven days of the written order unless tied to the Oct. 10 compliance schedule in the mailed order.
The hearing record noted the respondent was not present. The magistrate directed the city to mail the written order and to list deadlines and payment details; the order will be the formal starting point for any appeal and for any enforcement of fines if compliance is not met by the deadline.
