The Tuttle City Council on Monday adopted ordinance 2025-01 (PC2025-04), approving a planned unit development review for property at 2309 East Highway 37 and adding language to allow future site-specific special-use permit reviews as individual end users propose uses.
City staff said the revised ordinance clarifies how the PUD will handle uses as the property develops, allowing the city to review site-specific items such as parking, building setbacks and buffering when end users seek to occupy individual lots. David (city staff) said the change was intended to give the city flexibility to tailor conditions “for things like parking, things like building setbacks” as final users and developers come forward.
Supporters on the council said the ordinance makes a previously difficult-to-develop parcel usable while preserving city review authority. Opponents expressed concern that the approach could put the council in the position of “picking winners and losers” if future uses require differing levels of parking or other site requirements.
The council voted on the ordinance by roll call. Council member Scott Dixon voted yes, Council member Hughes voted yes, Council member Watson voted yes and Mayor McLeroy voted no; the ordinance passed. The council then voted separately on the ordinanceemergency clause, which requires four affirmative votes to take immediate effect. The emergency-clause motion passed on a separate roll call with Dixon, Hughes, Watson and Mayor McLeroy voting yes; the ordinance will therefore take effect immediately.
The ordinance includes language the council said was added after an earlier meeting; staff explained the packet originally lacked the final amended language and that David had drafted the updated text to capture council direction.
What the ordinance does: it establishes a PUD for roughly 19 acres at the cited address and preserves the city uthority to require site-level special-use permit (SUP) reviews for specific land uses proposed later by developers or tenants. The council noted buffering and other adjacency protections will be considered when individual uses are proposed.
Next steps: with the ordinance adopted and the emergency clause enacted, staff said the city can accept developer applications and evaluate SUP requests for individual lots as proposals arrive. The council did not specify any immediate applicants or tenants during the discussion.
