The Boca Raton City Council voted unanimously April 8 to reverse the Planning & Zoning Board and grant an appeal that blocks a site plan amendment and three technical deviations for a proposed freestanding emergency room (ER) at 1001 East Telecom Drive.
The matter had been the subject of an extensive quasi-judicial proceeding at the March 18 hearing and was continued to April 8 for limited additional presentations and council deliberations. The dispute centered on three technical deviations requested by the applicant: a reduced driveway reservoir distance for a west-side driveway, a reduced number of vehicle parking spaces (120 required reduced to 82), and an increase in the number of reserved parking spaces from five to nine.
Development Services staff and the applicant presented technical reports, shared-parking analysis and usage counts from comparable facilities, and recommended approval. Appellant counsel argued the application failed multiple technical-deviation criteria, including that the applicant did not demonstrate the minimum deviation necessary to make reasonable use of the property and that the asserted site constraints were self-created.
Appellants raised concerns about circulation, ambulance and delivery vehicle maneuvers, the location of ambulance loading adjacent to a driveway aisle, and the lack of an operational plan in the record before Planning & Zoning. Council members noted Planning & Zoning minutes showed board members who voted to approve nevertheless expressed concerns about parking and other issues.
After deliberation, council members concluded the applicant had not satisfied the technical deviation criteria — particularly for parking — and that alternative designs or a smaller building footprint could have reduced the need for deviations. Council voted to reverse the Planning & Zoning Board's decision and deny the site plan amendment by voice vote (5–0).
