Englewood board extends lead-service requirements to customers outside city limits

The Englewood Water and Sewer Board voted to adopt a code amendment extending the city's lead service line replacement requirements to extraterritorial customers who receive water services but live outside the Englewood city limits.
Staff said the change will affect roughly 400 customers in adjacent jurisdictions including a small piece of Littleton, parts of Cherry Hills Village and specific customers in Sheridan.
Sarah (Staff member) told the board the city started the lead replacement program after an April 2024 code change that defined service-line ownership and program financial conditions. "We began construction or replacing service lines in July of 2024," Sarah said, and as of the meeting she reported the city had replaced 809 lead or galvanized-steel service lines to date.
The amendment modifies Englewood Municipal Code sections 12-1(c)(2) and 12-1(c)(4) to extend the ownership definitions and program conditions to those extraterritorial customers. Board members asked whether outside-city customers pay higher water or sewer rates; Sarah answered that those customers pay slightly higher rates under the rates-and-fees process but are treated as customers of the same system and receive the same communications and outreach as in-city residents.
Board members moved and seconded the item and the motion carried. The action extends the city's existing lead-reduction requirements and the financial and outreach structure to the identified outside-city service areas, subject to the same program rules already applied inside the city.
Staff said the code change is intended to align the legal language with the program already underway and to make sure operations, billing and outreach are consistent across the utility service area. The city plans targeted outreach — a postcard and direct contacts to homes verified to have lead lines — in the extraterritorial zones as those replacement phases move forward.
Notes and next steps: staff emphasized that the program funding and schedule may be updated during the 2025 master-planning and budgeting process. Specific loan or grant allocations tied to extraterritorial replacements were discussed as part of broader funding presentations later in the meeting.
