City staff explained that Agundes purchased an adjacent property at 889 Sabine Avenue in February 2005 and had long used 2451 Sabine as part of his yard. Taxes on 2451 Sabine became delinquent and, after an unsuccessful auction, the parcel was struck off to the city. Agundes said he believed the adjacent lot had been part of his original purchase and sought to resolve the title through the unsolicited bid that covers back taxes and court and legal fees.
Staff said, if approved, the city would execute a deed without warranty releasing encumbrances and returning the lot to private ownership. Mr. Agundes was present in council chambers in support of the transaction. Councilmember Derek Weathers moved to approve OR2 as presented; Councilmember Blake Jones seconded. The motion passed unanimously.
The council did not specify a new deed recording date in the public transcript; staff indicated the transaction would cover taxes and legal fees and that the deed would be executed to clear the encumbrances on the property.
